If you are terminated without cause, you have the right to compensation. You have the right to be given notice of termination or to be paid in lieu of working during the required notice period.
Constructive dismissal occurs when you are not directly terminated by your employer, but your employer suddenly or frequently makes substantial changes to your employment agreement to put you in a position to either choose to accept the changers to your employment agreement or to quit.
Employment agreements protect your interests in employment disputes. As an employee, it sets your financial compensation for a period of time, as well as your benefits and possibly other forms of compensation. As an employer, it provides you with certain protections in the case where you will need to terminate the employment relationship with an employee.
In Alberta, and under the Alberta Human Rights Act, an employee is protected from being discriminated against from an employer for the following:
- Race
- Religious beliefs
- Colour
- Ancestry
- Gender
- Age
- Physical
- Mental disability
- Marital status
- Family Status
- Source of income
- Sexual Orientation
